Mississippi Residents File Class Action Against Musk's xAI and SpaceX Over Data Center Noise Pollution

The Legal Challenge Against Musk's Companies

Elon Musk's xAI and SpaceX have been sued by Mississippi residents who claim a power plant fueling nearby data centers is creating omnipresent and inescapable noise that has eroded their health and home values. The lawsuit, made public on Tuesday in federal court in Oxford, Mississippi, alleges that Musk's companies negligently failed to curb the disturbance and created a public nuisance through excessive and offensive noise.

Three residents filed the case on behalf of a class estimated at more than 10,000 members. The plaintiffs are seeking damages for alleged emotional distress, reduced property values and other harms, as well as disgorgement of an unspecified amount in profits. SpaceX and xAI did not immediately respond to requests for comment from Reuters. MZX Tech, an xAI subsidiary, was also named as a defendant, though Musk himself is not a named party in the lawsuit.

The Community Impact of Data Center Expansion

"The artificial intelligence [AI] boom is wreaking havoc on communities across the United States" by subjecting thousands of residents to near-constant noise and vibrations, the lawsuit stated. Robert Wiygul, a lawyer for the plaintiffs, emphasized that "Our homes are supposed to be a sanctuary for us against the world," but "When they are invaded by noise 24 hours a day, it takes that fundamental peace of a good and decent life away from us."

The power plant in question, built at Southaven with more than $20bn invested by xAI and the backing of Mississippi Governor Tate Reeves, uses gas-fired turbines to supply data centers in and around Southaven. The residents claim this industrial activity has fundamentally disrupted their quality of life in a residential area.

The Financial and Legal Implications

The lawsuit represents significant potential financial exposure for Musk's companies, with claims for damages covering emotional distress, reduced property values, and disgorgement of profits. The case comes amid substantial investment in AI infrastructure, with xAI alone committing over $20bn to the Mississippi facility.

This legal challenge adds to mounting difficulties for Musk's companies in the region. The civil rights group NAACP previously sued xAI in April over the same plant and data centers, accusing the company of violating US environmental rules. That lawsuit is still pending, and the US Department of Justice signaled in a court filing last month that it may intervene, noting the dispute raises legal and policy questions around the government's role in AI infrastructure.
